MEMORANDUM OF AN EXECUTIVE SESSION
 OF THE CLARKSVILLE TOWN COUNCIL
 HELD ON APRIL 21, 2008

A meeting of the Clarksville Town Council was called to order on April 21, 2008, at 7:00 P.M. in the meeting room of the Clarksville Municipal Center Administration Building by Council President Paul Kraft, who chaired the meeting.

Council members present: Paul Kraft, Gregory Isgrigg, Vicki Appleby, Raymond Richert, Donald Tetley, Bob Popp and David Fisher.  Council members absent:  None.   Also present at the meeting: Assistant Fire Chief Brent Wilson, Police Chief Dwight Ingle, Street Commissioner Donald Hansford, Town Engineer Tom Clevidence, Dorothea Leuthart representing the Wastewater Billing Office, Mike Otto representing the Town’s wastewater treatment facility management firm, Planning Consultant Sharon Wilson, Building Inspector Bob Polston, Town Attorney Chris Sturgeon, Clerk-Treasurer Gary Hall and Deputy Clerk-Treasurer Anita Elliott.

Approval of Fill Permit…  Mr. John McCoy of Isgrigg & Associates, representing Hardy Construction, Inc., requested permission to fill on two low areas of the construction company’s property located on State Road 60, advising that the company has received letters from the Department of Natural Resources and the Indiana Department of Environment Management stating that no permits are needed from those agencies.   Discussion followed regarding the fill area being outside of the Silver Creek floodway, the depth of the fill to be at a not-to-exceed maximum of ten feet, the necessity of inspections, the necessity of complying with the contingencies of the state agencies’ letters, conforming with the Town’s stormwater and erosion control ordinances, the Technical Review Committee’s agreement with the plan, and the expiration date of the permit.  Following discussion, a motion was made by Council Member Popp that a one-year fill permit be approved for the location specified contingent on conformity with all regulations, with permit renewal dependent upon review and approval by the Council on an annual basis.  The motion was seconded by Council Member Fisher and carried by unanimous vote.

Approval of Residential Parking at 322 East Carter Avenue…  Following the presentation of a request by Shawn Parker for a residential-parking-only sign at 322 East Carter Avenue, a motion was made by Councilman Isgrigg, seconded by Council Member Richert and unanimously carried to approve the requested residential-parking-only sign for 322 East Carter Avenue. 

Offer by Court to Purchase Approved Safety Equipment for Police Officers…  Town Judge Joseph P. Weber advised the Council that the Court has offered to purchase safety vests for officers with Alcohol & Drug program fees collected and deposited in the Town’s User Fee Fund.  Councilman Fisher reported that the Court is purchasing twenty-eight vests at a cost of $16,390.00, and offered thanks to Judge Weber.

Adoption of Additional Appropriation Ordinance No. 2008-BUD-02…  Council President Kraft announced that a public hearing on a proposed additional appropriation had been advertised for this meeting, and called for questions or comments from the public.  There being no public input regarding the proposed additional appropriations.  Following the presentation of a proposed ordinance numbered 2008-BUD-02 for the authorization of an additional appropriation in the Town’s User Fee Fund in the amount of $17,500.00, a motion to consider the proposed ordinance for adoption on its first reading at this meeting was made by Council Member Fisher, seconded by Council Member Appleby and carried by unanimous vote.  A motion to adopt Ordinance No. 2008-BUD-02 was made by Council Member Fisher, seconded by Council Member Appleby, and carried by unanimous vote.

Proclamation…  Council President Kraft read and signed a proclamation declaring the month of April 2008, “The Month of the Young Child” in the Town of Clarksville, Indiana.

Adoption of  Salary Ordinance No. 2008-S-01…  Following the presentation of a proposed ordinance numbered 2008-S-01 amending subsections 3.2 and 3.10 of the Town’s previously adopted ordinance numbered 2007-S-02, a motion was made by Council Member Richert that the proposed ordinance be considered for adoption on its first reading at this meeting.  The motion was seconded by Council Member Fisher and carried by unanimous vote.  A motion was made by Council Member Richert to adopt Ordinance No. 2008-S-01.  The motion to adopt Ordinance No. 2008-S-01 was seconded by Council Member Fisher and carried by unanimous vote.

Department Reports…  Police Chief Dwight Ingle thanked all of those helping with the Thunder event.  Council Member Popp acknowledged the receipt of the Wastewater Department monthly report, noting a picture of several wild turkeys on the front cover, and reporting that these turkeys were recent visitors at the plant.  Council Member Fisher offered his thanks to all those helping with the Thunder event.

Approval of Claims…  Accounts payable registers presented for approval consisted of Town pre-approved claims for the period from 4/2/08 through 4/18/08 in the amount of $566,250.14, Town and Wastewater/Stormwater utility gross payroll issued 4/11/08 in the amount of $326,160.41, Town current claims num­bered from zero through 79 in the amount of $71,032.23, Wastewater/Stormwater utility pre-approved claims issued 4/10/08 through 4/15/08 in the amount of $16,435.49, and Wastewater/Stormwater utility cur­rent claims numbered one through 17 in the amount of $6,951.78.  A motion was made by Council Member Appleby to approve the accounts payable registers presented.  The motion was seconded by Council Member Isgrigg and carried by unanimous vote.

Adjournment…   There being no further business to come before the Council at this time, April 21, 2008 meeting of the Clarksville Town Council was duly adjourned 7:24 P.M. on a motion made by Council Member Isgrigg, seconded by Council Member Appleby and carried by unanimous vote.
